Right of Withdrawal
Translation for convenience. The German version of these withdrawal instructions is the legally binding one; in the event of any discrepancy, the German text prevails.
The following withdrawal instructions apply to consumers in the case of brokerage contracts concluded as a distance contract or off business premises.
Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period will expire after fourteen days from the day of the conclusion of the contract.

of your decision to withdraw from this contract by an unequivocal statement, for example a letter sent by post, a fax or an email.
You may use the model withdrawal form set out below for this purpose, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of Withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract.
We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise.
In no event will you be charged any fees as a result of such reimbursement.
If you requested that we begin the performance of our services during the withdrawal period, you shall pay us a reasonable amount.
This amount corresponds to the proportion of the services already provided up to the point at which you inform us of the exercise of your right of withdrawal, in comparison with the full scope of the services agreed under the contract.
Early Expiry of the Right of Withdrawal
In the case of a contract that obliges you to pay a price, the right of withdrawal expires early if:
we have fully performed the service,
we only began performing the service after you had expressly agreed that we should begin performance before the end of the withdrawal period,
you have confirmed that you are aware that your right of withdrawal expires once we have fully performed the contract, and
you have been provided with a confirmation of the contract on a durable medium containing your express consent and your acknowledgement of that awareness.
Declaration Regarding Early Commencement
Where EBRO Immobilien GmbH is to begin work before the end of the withdrawal period, a separate express declaration must be obtained from the consumer.
Recommended wording of the declaration:
“I expressly request that EBRO Immobilien GmbH begin performing the brokerage services commissioned before the end of the fourteen-day withdrawal period.
I am aware that, in the event of withdrawal, I may owe compensation for the value of the services already provided up to the point of withdrawal.
I am further aware that my right of withdrawal expires once EBRO Immobilien GmbH has fully performed the contract.”
This declaration must not be pre-selected and must be actively confirmed.
